- Introduction
This Content Submission Policy (“Policy”) governs the submission of user-generated content (“Content”) to www.basepulse.africa (“the Website”), operated in the Republic of South Africa by Pulse Entertainment (Pty) Ltd (“Pulse”). By submitting Content, you agree to be bound by this Policy, our Website Terms of Use, our Privacy Policy, as well as applicable South African laws, including but not limited to the Electronic Communications and Transactions Act 25 of 2002 (ECTA), the Copyright Act 98 of 1978, and any other relevant legislation.
- Eligibility
- You must be at least 18 years old to submit Content or, if you are under 18, you must have the consent of a parent or legal guardian.
- By submitting Content, you warrant that you have the legal capacity to enter into this agreement.
- Ownership & Intellectual Property
3.1 Your Ownership
- You retain ownership of any original Content you submit.
3.2 License Granted to Us
By submitting Content, you grant Pulse a worldwide, non-exclusive, royalty-free, transferable license to:
- Use, reproduce, distribute, display, and perform the Content
- Adapt, edit, modify, and create derivative works
- Use the Content across all media platforms (including TV, digital, and social media)
This license is granted for the duration of applicable intellectual property rights, unless otherwise agreed in writing.
3.3 Moral Rights
- You waive (to the extent permitted by South African law) any moral rights that may restrict Pulse’s use of the Content.
3.4 Third-Party Rights
Content you submit must not include third-party intellectual property (for example: copyrighted material such as music or photographs) unless you have permission from that party or are otherwise legally entitled to do so. You are legally responsible for the Content you submit to the Website.
You confirm that:
- The Content is original, or
- You have obtained all necessary permissions, licenses, and releases from rights holders (including music rights, performers, and identifiable individuals)
- Prohibited Content
You may not submit Content that:
- Infringes any copyright, trademark, or other intellectual property rights
- Contains defamatory, harmful, or unlawful material
- Incites violence, hate speech, or discrimination (as defined under South African law)
- Contains explicit sexual content, nudity, or exploitation
- Promotes illegal activities
- Violates privacy rights or includes personal information without consent
- Contains malware, spam, or harmful code
Pulse reserves the right to determine, in its sole discretion, whether Content violates these rules.
- Content Moderation & Removal
- Pulse does not guarantee publication of any submitted Content.
- We reserve the right to:
- Review, edit, or remove Content at any time
- Suspend or terminate user access for violations
- In terms of the ECTA “notice and take-down” provisions, users may report infringing or unlawful content.
- Indemnity
You agree to indemnify and hold harmless the Website, Pulse, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from:
- Your submitted Content
- Your breach of this Policy
- Any infringement of intellectual property or other rights
- Privacy & Personal Information
- Any personal information submitted will be processed in accordance with the Protection of Personal Information Act (POPIA).
- By submitting Content, you consent to the processing of personal information where necessary for publication and promotion.

- No Compensation
Unless otherwise agreed in writing:
- You will not receive payment or royalties for your submitted Content.
- Submission is voluntary.
- Accuracy & Representations
You warrant that:
- The information associated with your submission is accurate
- You have all necessary rights to submit the Content
- The Content complies with all applicable laws and regulations
- Limitation of Liability
To the fullest extent permitted by South African law:
- Pulse shall not be liable for any indirect, incidental, or consequential damages arising from user Content
- Pulse provides its platform “as is” without warranties of any kind
- Takedown Notices (Rights Complaints)
If you believe Content infringes your rights, you may submit a notice including:
- Your full name and contact details
- Identification of the infringing Content
- Proof of ownership or authority
- A statement made in good faith
Upon receipt, Pulse will act in accordance with applicable legal obligations under the ECTA.
- Termination
We reserve the right to:
- Remove Content
- Suspend or terminate user access
- Take legal action where necessary
- Governing Law
This Policy is governed by the laws of the Republic of South Africa.
Any disputes will be subject to the jurisdiction of the High Court of South African (Gauteng South Division).
- Changes to Policy
We reserve the right to update this Policy at any time.
Changes will take effect upon publication on the Website. Continued use constitutes acceptance.
If any provision of this Policy is held to be unenforceable, illegal or in some other way invalid, the unenforceable, illegal or invalid provision will be deemed to be severable and will not affect the remainder of the provisions which will continue to be of full force and effect.
